PAIA Manual

Manual of Cr8tiveHub Digital Studios (Pty) Ltd in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (“PAIA”), read with the Protection of Personal Information Act 4 of 2013 (“POPIA”).

2. Information Officer

The Information Officer is Thokozani Dube, registered with the Information Regulator of South Africa under registration number 2026-011645.

All requests for access to records, and all queries about this manual, must be addressed to the Information Officer at legal@cr8tivehub.com.

3. Guide of the Information Regulator

The Information Regulator has compiled a guide, in terms of section 10 of PAIA, on how to use the Act. It is available from the Regulator at inforegulator.org.za, or by writing to the Regulator at PO Box 31533, Braamfontein, Johannesburg, 2017, or PAIAComplaints@inforegulator.org.za.

4. Records available in terms of other legislation

Records are held in accordance with, among others, the Companies Act 71 of 2008, the Income Tax Act 58 of 1962, the Value-Added Tax Act 89 of 1991, the Basic Conditions of Employment Act 75 of 1997, the Electronic Communications and Transactions Act 25 of 2002, the Consumer Protection Act 68 of 2008 and POPIA. Access to those records is governed by the legislation concerned and is not automatically available under this manual.

5. Categories of records we hold

The categories below describe what exists. Listing a category is not an undertaking that a request for it will be granted — access is decided against the grounds for refusal in Chapter 4 of PAIA, and personal information about a third party is refused unless that person consents.

6. How to request a record

A request must be made on Form 2 of the PAIA regulations, sent to the Information Officer at the address in section 2. The request must give enough detail to identify the record and the requester, state the form of access required, and give an address in the Republic for the reply. Where a request is made in the interest of another person, the capacity in which the requester acts must be stated and be satisfactory.

Your own personal information is simpler. If you hold a Cr8tiveHub account, you can download everything we hold about you directly from your account settings, immediately and at no charge — you do not need to use PAIA at all. The same screen lets you delete your account.

7. Decision and timelines

The Information Officer will decide within 30 days of receiving the request and notify the requester in writing. That period may be extended by a further 30 days in the circumstances allowed by section 57, in which case the requester will be told why. If a request is refused, the notice will give the reasons and explain the right to lodge a complaint with the Information Regulator or to apply to a court.

8. Fees

A request for your own personal information carries no request fee. Any other request attracts the request fee and access fees prescribed under PAIA, and the Information Officer will notify the requester of the amount before processing continues. Fees are those published in the PAIA regulations, as amended from time to time.

9. Grounds on which access may be refused

Chapter 4 of PAIA requires or permits refusal in defined circumstances, including the mandatory protection of the personal information of a third party, the commercial information of a third party, information supplied in confidence, and records privileged from production in legal proceedings. Requests for another user’s personal information — including identity documents — will be refused unless that person consents or the Act requires disclosure.

10. Complaints

A requester who is dissatisfied may lodge a complaint with the Information Regulator at PAIAComplaints@inforegulator.org.za, or apply to a court as provided in the Act.

11. Availability of this manual

This manual is available on this page free of charge, and on request from the Information Officer in an alternative format where reasonably practicable. It is reviewed at least annually.
